General Terms and Conditions (including Age requirements)
Before we get started please note that by using our website and purchasing our products or services it means that you agree to our terms and conditions.
So as to protect your own interests please read the conditions carefully before ordering. If you are uncertain as to your rights under them or if you want an explanation about them please write to our customer queries department at customerservice@cuckooland.com.
Our Contract
These terms and conditions govern the supply of goods sold by Flair Furniture Ltd t/as Cuckooland (No. 07536751) of Old Delivery Office, Oldfield Lane, Heckmondwike, West Yorkshire, WF16 0JD (we and us) to the customer (you). Our VAT number is 121713455.
All orders placed by you and purchases of goods from us (whether by telephone or via our website) are on the basis of these Terms and Conditions and subject to acceptance by us by delivery of the goods to you.
The processing of your payment and acknowledgement of your order (including sending you an email confirming your order is being processed) does not constitute legal acceptance of your order.
Ordering
On our website, you may place an order to purchase a product advertised for sale by following the onscreen prompts after clicking on the item you wish to purchase. You will have an opportunity to check and correct any input errors in your order up until the point at which you place your order by clicking the "Place order and pay" button on the checkout page.
All orders placed by you and purchases of goods by you from us, are subject to acceptance by us (as described above). We may choose not to accept your order or purchase for any reason and will not be liable to you or to anyone else in those circumstances.
Where we accept your order, we have a legal duty to supply goods that are in conformity with these Terms and Conditions.
Price and Payment
The price payable for the goods you order or purchase is as set out on our website at the time you submit your order, plus any charges for delivery as advised to you. All prices include the current applicable VAT rate unless otherwise stated.
Occasionally, we advertise goods at a promotional price; you must quote the relevant promotion code, otherwise you may be charged the full price.
Occasionally, an error may occur and goods may be either incorrectly priced or described in which case we will not be obliged to supply the goods at the incorrect price or in accordance with the incorrect description or at all. We reserve the right to correct any errors from time to time. We will (at our discretion) either cancel your order and refund the price you have paid or use reasonable endeavours to contact you and ask you whether you wish to continue with the order at the correct price or correct description. If we are unable to contact you or you do not wish to continue with the order at the correct price or correct description, we will cancel your order and refund the price you have paid.
We must receive payment for the whole of the price of the goods you order and purchase, and any applicable charges for delivery, before your order can be processed unless we have agreed otherwise in advance in writing.
For website orders, payment can be made by most major credit or debit cards or PayPal, by completing the relevant details on the checkout page.
By using a credit/debit card to pay for your order or purchase, you confirm that the card being used is yours or that you are authorised to use it. By using PayPal you confirm that the PayPal account being used is yours.
All credit/debit card holders are subject to validation checks and authorisation by the card issuer. All PayPal payments are subject to authorisation by PayPal. If the issuer of the card or PayPal refuses to authorise payment we will not accept your order or purchase, we will not be obliged to inform you of the reason for the refusal, and we will not be liable for the item not being delivered or provided to you. We are not responsible for the card issuer or bank charging the holder of the card as a result of our processing of your credit/debit card payment in accordance with your order or purchase or if PayPal charges you for making the order.
We recommend that you do not communicate your payment card details or PayPal details and password to anyone, including us, by email. We cannot be responsible for any losses you may incur in transmitting information to us by internet link or by email. Any such loss shall be entirely your responsibility.
If you are a trade customer, you are responsible for all orders placed by your employees and for any purchases made on cards issued to you and we are not bound by any individual order limit you may impose on your employees. If you are a trade customer, you may not withhold payment of any invoice or other amount due to us by reason of any right of set off or counterclaim, which you may have, or allege to have.
We shall be entitled at all times to set off any debt or claim which we may have against you against any sums due from us to you.

General Terms
If any of the above terms have been breached, Cuckooland.com may remove, cancel or suspend access to and use of Cuckooland.com without prejudice to Cuckoolands other rights. We may simply change or withdraw any part of Cuckooland.com and we may refuse you access to Cuckooland.com at any time if we feel it’s necessary.
Similarly, Cuckooland.com may decide to terminate this agreement if a user is at fault.
Cuckooland does not act or have rights to act as an agent for the consumer or any other person.
If any provision of these terms and conditions are not enforced by Cuckooland it does not constitute a continuing waiver
If any of these terms is held to be unenforceable, the remainder of the provisions will remain in force and effect.
These terms replace any and all previous terms and conditions and constitute the full agreement between Cuckooland.com and its users.
These terms should be read in conjunction with all other headings, subjects, points and clauses in our Help section on the left hand side of this page, all these headings, their subject matter, points and clauses form part of these terms and conditions- for usability and quick reference purposes these points have been extracted and placed in the navigable box with clickable links to each section.
We cannot guarantee that these terms and conditions accord with local laws of other countries outside the UK and EU/EC.
Age requirements by Law: Within the UK it is an offence to sell knives, pointed articles, alcoholic beverages and certain adult products to persons under 18 years of age. We are not allowed by law to supply these products to you. This is why we ask for confirmation of your age before you can complete your order through the checkout process on our website. We also reserve the right to request proof of age at any time and to refuse to fulfil orders and supply to customers that we suspect do not meet the legal age requirements. Please do not order these products if you are under the age of 18.
These terms are subject to the laws of England and the jurisdiction of the English Courts.

Cuckooland Responsibilities
Cuckooland insures all deliveries at the retail value of the product/s delivered. We will unfortunately not be able to cover any subsequent loss or destruction of the delivered products so please check the products as soon as you receive them.
Cuckooland will always make the descriptions and pictures of each product as accurate as possible but please check the scale and the dimensions (when available) on our site for exact sizes prior to ordering.
Cuckooland does not give any guarantees, warranties or representations in respect of any other person`s services.
Cuckooland is not responsible to you if we cannot provide our Internet services, we maintain our site on an “as is” and “if available” basis and we cannot promise that our service will be uninterrupted or completely error free. Although we will try our level best.
Similarly Cuckooland.com contains links to other websites which we have no control over; we therefore have no influence or authority over them and their content. However if you take offense to any link we provide, please email us and we will investigate.
Except for those terms provided above we cannot give any other warranties, conditions or other terms (express or implied, statutory or otherwise) and all such terms are hereby excluded to the maximum extent by law.
This does not affect your rights as a consumer. They also do not exclude or limit Cuckoolands liability for death or personal injury resulting from our negligence or any representation of any fraudulent nature.
If failure to perform any of our obligations is caused by any unforeseen events beyond our reasonable control including and without limitation to: Communications outages, Internet outages, fire, flood, war or act of God; we will not be liable in any way.
Cuckooland hereby advises every Cuckooland shopper to read the products instructions, manuals and other user documentation very carefully. We are not involved in the manufacture of products and cannot advise on their use or operation. All products must be used safely and in accordance with the manufacturer’s guidelines.
As with every term this does not affect your statutory rights as a consumer.
Cuckooland will not be held automatically liable for any loss or damage of any kind however so arising, including any direct, indirect or consequential loss you notify us about. We are neither liable nor liable to pay any money by way of compensation in relation to:
- Any delays or interruptions in updating Cuckooland.com;
- Any Intellectual Property Rights infringement of any third party caused by using Cuckooland.com or any product purchased through Cuckooland.com;
- Any inaccurate or incorrect information on Cuckooland.com;
- Any loss or damage resulting from the use of Cuckooland.com;
- Any loss or damage resulting from your inability to use Cuckooland.com;
- Any loss or damage resulting from unauthorized access to Cuckooland.com;
- Any loss or damage resulting from any alterations of your transmissions or data outside of our control;
- Any losses occurred, whether profit, wasted expenditure, corruption or destruction of data which is not a direct result of something we have done wrong;
- Any losses occurred, whether damage of otherwise, which are due to viruses or other malicious software that may infect a user’s computer equipment; data, software or other property;
- Any losses occurred, whether damage or otherwise, caused by persons accessing, downloading or using Cuckooland.com;
- Any losses occurred, whether damage or otherwise, arising out of transmissions sent via email or attachments received from Cuckooland or our licensees and affiliates;
- Any other site linked to Cuckooland.com and its availability, quality, content or nature. Including the storage and distribution of personal data, confidential information, cookies or other services offered by these External Third Party sites. Please contact these sites administrators or webmasters if you have any concerns or questions regarding their website, their links, services or transactions.
- If the product you have purchased is for commercial use (ie, hospitality, school, care homes etc), unless you have previously contacted us to confirm the product is suitable for commercial use/purposes, we will not be held liable for any damages/returns. We therefore recommend that before you purchase the product to contact us to make sure the product is suitable for commercial purposes.

Our Price Match Promise
At Cuckooland we are dedicated to bringing you the very best products (of the highest quality) from around the World with the best, most personal customer service known to mankind (and Zebras)... all at the best possible prices. We would never want price to be the reason you shop elsewhere, so in the unlikely event that you do find another retailer offering the same product at a cheaper price, we will do our best to match it.
Simply make a note of the product name, its price (including delivery), the link to buy online and email this information along with your contact details and delivery address to our customer services team: customerservice@cuckooland.com. We will verify the details and do our best to match the price as long as it meets the terms and conditions outlined below.
Price Match Terms and Conditions
- We will only match prices for identical products on our website. The additional services offered (delivery, installation, timescales) must also be the same.
- The product must be in stock with the competitor and ready for delivery.
- Unfortunately we are unable to price match auction websites, market places (including eBay and Amazon), private sellers, factory shops, clearance/warehouse outlets or retailers that are in administration or closing down.
- We only price match competitors that trade on the same basis as us, that offer a comparable shopping experience and the same high standards of customer service.
- Price match cannot be used in conjunction with any other Cuckooland promotion, discount or voucher code offer.
- Price match is product specific and excludes site-wide promotions, sales and discount codes offered by our competitors. If you are unsure please call our customer services team.
- Price match is only available at the time of order and cannot be applied retrospectively.
- We will always do our best to price match, but it is at our discretion and we reserve the right to decline a price match request.
- We reserve the right to withdraw or change this offer at any time, and decline a request where the terms and conditions have not been met or the price match .
